This letter is intended to explain the BOD intentions behind the Environmental Best Management Practices (from this point BMPs) and why they are important for members of PWNA and the industry at large. My goal is to explain what the BMPs are and what they are not.

Let me begin that neither the BOD nor I saw that the voting on the BMPs would create such a response. The response was surprising, disappointing, and encouraging all at the same time. Let me address each of these:
· Surprising - we post things almost everyday with little or no notice. The BMPs

that were voted on was part of the process to make the BMPs official so that

we could use those BMPs as part of an Environmental Certification course

currently being developed. Education is one of the "pillars" of the PWNA and is

one of the ways we bring real value to our members. Also, these BMPs have

been around the PWNA for many years. These BMPs are not new, just

reformatted to be easier trained and understood. Nothing new.
· Disappointing - the things that were said about people who volunteer their

time and talents to make our industry better is always disturbing to read and

reflects poorly on our industry.
· Encouraging - it is positive to see such interest in this topic. The BMPs are a

work in progress and the more help we can get the better. Typically, these

sorts of things are worked on by only 1 or 2 dedicated people and then

approved by a group. The BOD welcomes and appreciates the input and

comments from everyone to make these BMPs the best they can be for all

involved.

Let me explain what the BMPs are:
· An educational tool - to be used as part of an Environmental Certification

course. For me personally, I have spent all of my time on residential services

like wood restoration, roof cleaning and house washing. I recently began

commercial exterior cleaning and fleet washing and I had no idea where to

begin as it relates to the Clean Water Act (CWA from this point). I found the

current PWNA BMPs difficult to understand and they left me with many

questions. However, I didn't know where to begin without them. The PWNA is

leading this important topic.
· A resource for your employees - we wanted to have a document that could be

part of every members operation, if they chose. Take these BMPs and use

them as they are or use them to start developing your own company BMPs

based on the services you provide and the geography you serve. They are a

living and open document that can be modified and applied by anyone that

wants them.
· Protection - having BMPs and being Water Reclaimer Certified can be used to

demonstrate to local regulators and municipalities that you are a trained

professional. They will know that you are doing what you can to protect our

lakes, rivers, streams and oceans. The PWNA is here to protect our members

and help them to be more profitable. You may not agree, and that's fine, but

that is what the BOD believes.
· Helping keep our waters clean - Some cities have not developed their own

BMPs, others have. Part of phase 2 of the EPA (as I understand it) requires

cities to develop their own BMPs. If all of us can do the work for them by

writing or at least influencing the writing of their BMPs, better for your city,

better for you the contractor and better for the environment. The services

each of us as contractors perform is to keep things clean and to protect the

health and safety of our customers. No one is more interested in protecting

the environment than those of us in the power washing industry.

Let me tell you what the BMPs are not (based on some of the points I read on the bulletin boards):
· The PWNA is not going to bring, or shop, the BMPs to municipalities, city

leaders or roll them out across the country. That was never mentioned as our

plan and I don't know where that came from. Second, we don't have the

money or resources for such an undertaking.
· These BMPs aren't designed to be the answer for every power washer, in every

part of the country, for every possible cleaning situation or challenge. They are

a guide. They are a resource to develop BMPs specific to your operation.
· They will not solve the Houston problem. These BMPs are written to comply

with the CWA. What is happening in Houston is not about the CWA. As you

can read toward the beginning of the BMP document "[FONT=&quot]If your discharge does not
[/FONT]
[FONT=&quot] reach the waters of the United States, then there are no requirements under the Clean Water
[/FONT]
[FONT=&quot] Act." [/FONT]
· The BMPs are not applicable to residential services such as house washing, roof

cleaning or deck cleaning unless wash water will reach a storm drain. If the

water doesn't hit the storm drain, these BMPs do not apply.
· The BMPs are not about enriching anyone. To be on the BOD, 50% or more of

your revenue must come from contract cleaning. Michael Hinderliter had to

leave the Board when he bought Delux from Robert and the new bylaws were

passed. Although Robert Hinderliter is the Environmental Chairman, he is not

one of the Board of Directors. The BMPs are about education and guidance.

We aren't suggesting anyone buy a particular type of equipment or to buy any

equipment at all. It is up to the individual contractor as to how he or she will

meet the requirements of the CWA.
· We are not submitting these BMPs to the EPA on April 15th or any other date.

We are not submitting these BMPs to any government authority. They will be

available on the PWNA website to anyone who wants to read them. We are

asking for member comments to be returned by April 15th to keep the process

moving.
· The BMPs don't suggest that we are polluters. If I'm mistaken, please email

which line or lines of the draft you are referring to and the correction or

corrections will be made.

It is the position of the BOD that our industry support the Clean Water Act and the PWNA will support rules that are practical, reasonable and economically feasible to protect our lakes, rivers, streams and oceans. If we find municipalities that are overreaching or are unreasonable, we will do what we can to address those cities (this is where we need everyone to be a member, my only plug). Power washing contractors are parents, sportsmen and sportswomen who want to leave our world better than we inherited it. I would like to believe that few of us would disagree.

At least you know now that when the PWNA posts something, it is, in fact being read. Part of the reason this announcement got so much negative response was the (probably unintended) presumptuousness implied when it was stated the the BMP's would be voted on, then open for comments without soliciting comments in advance from the industry at large.

Another reason for the negative response is quite possibly the direction this is headed, whether intentional or not. Many contractors are doing fine within their own geographic areas without the benefit of any kind of certification.

You won't have to shop the BMP's to local governments, they will find your website and adopt your BMP's just like they've done on the KEC side. (along with a little promotion)

Mike, the following two paragraphs appear to contradict each other.

· Helping keep our waters clean - Some cities have not developed their own

BMPs, others have. Part of phase 2 of the EPA (as I understand it) requires

cities to develop their own BMPs. If all of us can do the work for them by

writing or at least influencing the writing of their BMPs,
better for your city,

better for you the contractor and better for the environment. The services

each of us as contractors perform is to keep things clean and to protect the

health and safety of our customers. No one is more interested in protecting

the environment than those of us in the power washing industry.

Let me tell you what the BMPs are not (based on some of the points I read on the bulletin boards):
· The PWNA is not going to bring, or shop, the BMPs to municipalities, city

leaders
or roll them out across the country. That was never mentioned as our

plan and I don't know where that came from. Second, we don't have the

money or resources for such an undertaking.


Either we are going to influence them or we aren't. Either the BMP's are a "training tool" or they are intended to "influence".

That's where the problem comes in. IF we are going to influence, it's my opinion that we need to do so from an offensive posture. The offense consisting of the fact that we are ALREADY good stewards of the environment and without our services the environment would be far worse.

There's more I'd like to say about this, but I'm short on time this afternoon.

At least for once this is a time when the entire industry appears to be awoken into an action mode. I hope it keeps up.
 
I am FAR from the smartest person in the room and don't understand how these things work exactly. However, it would seem to me that the local governments are going to impose regulations one way or the other, and it would seem to me that heading them off with our own plan and guidlines would make more sense than waiting for the boneheads wearing $1000 shoes and sitting in their comfy offices to impose what they believe is right. At the same time we have to be reasonable and propose a certain amount of regulation if they're going to take us seriously..

Again, JHMO and I don't fully understand BMPs or that part of the industry.
 
Robert Annouced this program at NCE Prattville Alabama 2009, he said history with the PWNA would not repeat itself. Its repeating itself now, contractors around the Globe have been hurt because of lack of support. Your in a bad spot, dam if you do and damed if you dont.


Just throwing these out and saying your not shopping them is just as bad.

Houstons problem lies in the misinterpitation of the BMP's. They are similiar like almost all the same. Little twists can changed things drastically for the business owner.

I careless about these BMP's, education to the entire industry on how and why these are in place will be my mission. Teaching you and the rest of the BOD and contractors what they really mean will be my focus.

If you think these do not apply to house washers and deck restoration your mistaken. Citys incorrectly include and catagorize us by our trades. (Fleets,Deck,detailer,sidewalk)

By far over the last three Year National Cleaning Expo has had regulators and Law makers speaking at events educating the industry about these issues. Advancements with these muni's have come further in the recent years than the last 20. Moving backwards is something I will not do, if the PWNA wants to showcase a program for a revenue stream of helping associate members sell vaccums I'm not ok with this. The PWNA is for the contractors and this BMP was not even a good first draft in the favor of contrators.

Director. It was reviewed and commented on by the PWNA Board of Directors. This letter has been approved for distribution by the PWNA Board of Directors (BOD from this point).

This letter is intended to explain the BOD intentions behind the Environmental Best Management Practices (from this point BMPs) and why they are important for members of PWNA and the industry at large. My goal is to explain what the BMPs are and what they are not.

Let me begin that neither the BOD nor I saw that the voting on the BMPs would create such a response. The response was surprising, disappointing, and encouraging all at the same time. Let me address each of these:
· Surprising - we post things almost everyday with little or no notice. The BMPs

that were voted on was part of the process to make the BMPs official so that

we could use those BMPs as part of an Environmental Certification course

currently being developed. Education is one of the "pillars" of the PWNA and is

one of the ways we bring real value to our members. Also, these BMPs have

been around the PWNA for many years. These BMPs are not new, just

reformatted to be easier trained and understood. Nothing new.
· Disappointing - the things that were said about people who volunteer their

time and talents to make our industry better is always disturbing to read and

reflects poorly on our industry.
· Encouraging - it is positive to see such interest in this topic. The BMPs are a

work in progress and the more help we can get the better. Typically, these

sorts of things are worked on by only 1 or 2 dedicated people and then

approved by a group. The BOD welcomes and appreciates the input and

comments from everyone to make these BMPs the best they can be for all

involved.

Let me explain what the BMPs are:
· An educational tool - to be used as part of an Environmental Certification

course. For me personally, I have spent all of my time on residential services

like wood restoration, roof cleaning and house washing. I recently began

commercial exterior cleaning and fleet washing and I had no idea where to

begin as it relates to the Clean Water Act (CWA from this point). I found the

current PWNA BMPs difficult to understand and they left me with many

questions. However, I didn't know where to begin without them. The PWNA is

leading this important topic.
· A resource for your employees - we wanted to have a document that could be

part of every members operation, if they chose. Take these BMPs and use

them as they are or use them to start developing your own company BMPs

based on the services you provide and the geography you serve. They are a

living and open document that can be modified and applied by anyone that

wants them.
· Protection - having BMPs and being Water Reclaimer Certified can be used to

demonstrate to local regulators and municipalities that you are a trained

professional. They will know that you are doing what you can to protect our

lakes, rivers, streams and oceans. The PWNA is here to protect our members

and help them to be more profitable. You may not agree, and that's fine, but

that is what the BOD believes.
· Helping keep our waters clean - Some cities have not developed their own

BMPs, others have. Part of phase 2 of the EPA (as I understand it) requires

cities to develop their own BMPs. If all of us can do the work for them by

writing or at least influencing the writing of their BMPs, better for your city,

better for you the contractor and better for the environment. The services

each of us as contractors perform is to keep things clean and to protect the

health and safety of our customers. No one is more interested in protecting

the environment than those of us in the power washing industry.

Let me tell you what the BMPs are not (based on some of the points I read on the bulletin boards):
· The PWNA is not going to bring, or shop, the BMPs to municipalities, city

leaders or roll them out across the country. That was never mentioned as our

plan and I don't know where that came from. Second, we don't have the

money or resources for such an undertaking.
· These BMPs aren't designed to be the answer for every power washer, in every

part of the country, for every possible cleaning situation or challenge. They are

a guide. They are a resource to develop BMPs specific to your operation.
· They will not solve the Houston problem. These BMPs are written to comply

with the CWA. What is happening in Houston is not about the CWA. As you

can read toward the beginning of the BMP document "[FONT=&quot]If your discharge does not
[/FONT]
[FONT=&quot] reach the waters of the United States, then there are no requirements under the Clean Water
[/FONT]
[FONT=&quot] Act." [/FONT]
· The BMPs are not applicable to residential services such as house washing, roof

cleaning or deck cleaning unless wash water will reach a storm drain. If the

water doesn't hit the storm drain, these BMPs do not apply.
· The BMPs are not about enriching anyone. To be on the BOD, 50% or more of

your revenue must come from contract cleaning. Michael Hinderliter had to

leave the Board when he bought Delux from Robert and the new bylaws were

passed. Although Robert Hinderliter is the Environmental Chairman, he is not

one of the Board of Directors. The BMPs are about education and guidance.

We aren't suggesting anyone buy a particular type of equipment or to buy any

equipment at all. It is up to the individual contractor as to how he or she will

meet the requirements of the CWA.
· We are not submitting these BMPs to the EPA on April 15th or any other date.

We are not submitting these BMPs to any government authority. They will be

available on the PWNA website to anyone who wants to read them. We are

asking for member comments to be returned by April 15th to keep the process

moving.
· The BMPs don't suggest that we are polluters. If I'm mistaken, please email

which line or lines of the draft you are referring to and the correction or

corrections will be made.

It is the position of the BOD that our industry support the Clean Water Act and the PWNA will support rules that are practical, reasonable and economically feasible to protect our lakes, rivers, streams and oceans. If we find municipalities that are overreaching or are unreasonable, we will do what we can to address those cities (this is where we need everyone to be a member, my only plug). Power washing contractors are parents, sportsmen and sportswomen who want to leave our world better than we inherited it. I would like to believe that few of us would disagree.

I am FAR from the smartest person in the room and don't understand how these things work exactly. However, it would seem to me that the local governments are going to impose regulations one way or the other, and it would seem to me that heading them off with our own plan and guidlines would make more sense than waiting for the boneheads wearing $1000 shoes and sitting in their comfy offices to impose what they believe is right. At the same time we have to be reasonable and propose a certain amount of regulation if they're going to take us seriously..

Again, JHMO and I don't fully understand BMPs or that part of the industry.


I disagree Scott. The HVAC industry tried that. They held out the olive leaf and the government chopped off their hand. Now it's extremely difficult to make a living in that industry and on the residential end they hold a reputation somewhere on the level of a used car salesman. It didn't help their public perception one bit.

On the other hand the Concrete industry fights tooth and nail and have VERY reasonable guidelines to follow. How many times have you seen someone vacuuming a construction site for water?

The got those reasonable guidelines because they started from that position that construction is necessary and there is a certain amount of runoff that is inevitable. They aren't even in the fight anymore. They are back to working without worrying so much about the local governments.

The problem I see is like Tony said. You have these BMP's on your website and municipalities could and probably will see them. They may search out a pressure washing Org and PWNA & the BMP's will show up. You, the PWNA represnt about 250 contractors and not all of them and possibly a majority of them if educated may be against the PWNA BMP's. We may never know. I know from being on the UAMCC that when you ask for input or suggestions a small percentage generally respond and many never do. I hope you get better responses but I would bet less than half responded to the PWNA request for input.

Now you represent 250+ but authorities may think you represent ALL the industry and the fact is you don't. I have talked to 8 other contractors a few are members of the PWNA as contractors and one as a distributor and all said they didnt like the PWNA BMP and it also helps Distributors more than contractors

Now what if the municipalities take your BMP and use it right here in Myrtle Beach I will have to give up the $25K-$40K in garages I do a year and I DON'T want to, but that is what your BMP could do to ME. Garages arent my niche but its good winter work. I do not want to buy reclaim for that small amount of work. I have mentioned it before I just did 2 garages with NO reclaim and the city wastewater lady helped me come up with the process


You want to educate fine, educate how to do 90% of the work with NO reclaim. I dont want the Fort Worth or PWNA BMP to see the light of day. and I feel well over 3/4's of the contractors in the country probably do not want to see it either. Thats maybe 10,000, 20,000 contractors compared to the 250+ PWNA members, which many of your members dont want your BMP either

I suggest taking your time and listening to us and lets get more involved in the conversation and then stand up as an industry against 90% of the bad points of many BMP's. If you stand against big government imposing more and more regulations I even would bet your membership would grow

Got to go now got a 4 & 7 year old knocking at my office door. I do have more thoughts and more are always coming to mind as I listen to other contractors on the BB's and by phone. List Mr Hillborn, dont rush, listen and we all may be able to make things better for CONTRACTORS and our businesses

Why "Piggy Back" Ft. Worth? You already have a pretty good Environmental Training/BMP with Pete at Sunbrite. I took the course last year. Or why not write one of your own that parallels the CWA, and one that can fit every Member?

Why adopt a BMP into the PWNA If it does not represent Every Member? There are other avenues of Education for your "Pillars"

I have no idea why you or the BOD are shocked at the response this announcement got, unless the BOD has "Lost Touch" with the Industry, and by that I mean Contractors.

I really don't understand how the BOD can get behind this when they don't even understand what the BMP's are saying.

If you don't think Cities or States are looking for ideas on BMP's or how to better enforce their existing BMP's, are going to find the one that you will endorse on your website....well all I have to say is google "Pressure Washing BMP's" and see what jumps up, yea that will shock you.

Tougher enforcement of BMP's would not affect "Muilt-Million Dollar Companies" they can afford to do what ever is necessary to comply. This Can affect the "Mom & Pop's" small companies with limited resources.

Mike, please remember that "Organizations" do not speak for they're perspective Industry, they speak for they're Members.

I posted on TGS, that the PWNA was going to submit this BMP to the EPA April 15, I have been assured by Mr. Hilborn that this is not true and I take him at his word. Since we are being vague on the source I want Pwna to know I'm not the source spreading false info.

Thats a good statement, in reality the PWNA represents very little as far as contractors go, I am guessing (and I am sure I am wrong) but 250 members is probably less than 1% of the contractors in the USA.

Mine either, my day is spent answering the phone all day over this topic, so lets move on for now so we can make money

I have bigger issues at hand like scheduling 40+ restaraunts, 30+ pharmacys and 11 shopping centers plus some building washes that have to be done in the next two weeks. THAT IS WHAT MEANS THE MOST TO ME RIGHT NOW!
 
They wrote it for the city exception in th BMP. Why have that in the BMP if you not going to use it?

The hell with that, you comments are needed, you are helping educate me and other contractors, along with all in the coalition and indsutry. We are a team
It was some of you advise and help that allowed me to be able to was those 2 parking garages in MB without any reclaim.
 
I'm happy to help and drive the coalition to succeed in the industry. Houston familys and contractors need us, this PWNA bmp's is only here to benifit PWNA distributors members. If they where serious they would have listened to my recommendations. I'm through with this, PWNA members will speak loud and clear if they do not fix this. Members are watching to see what this BOD is going to do about the problems at hand. Building programs for contractors not Associates.

The water reclaim was launched by the PWNA in Alabama in 2009, they are not even aware of there own history.

History keeps repeating and I'm frankly tired of being involved with people who are not aware of making the same stupid mistakes.

So I'm not stopping the work on the PWNA or coalition, I'm simply refusing to discuss this blunder by these poor volinteers that work so hard.

That was very offensive telling members to shut up because people are volinteering there time and should basically shut up. Are we fourth graders? This is a proffessional org and to have written in a BOD letter about how selfless they are was over the top.

Each person that particpates here has possibly done more for themselves and the industry than the orgs combined.

I'll say it again, we have kept contractors working in drought, stopped ridiculous laws being passed by citys and countys. ( ALL ALONE)

I'm offended when comments are made about its just the BBS, this BBS and others do more good than harm any day of the week.

They are reading this and I typed a reach out letter apoligizing for hanging up on them during the conference call. I'm sorry that they wasted time, I'm sorry I allowed to get upset over a person down playing the problem in houston when five others saw the same thing I saw.

Jeff, Please understand that I'm very sick and tired of orgs rebuilding here. After then get a few people they really think they are the greatest thing since sliced bread. I really wish the PWNA would pull there head out and start moving forward again.

We just need to lead by example, they will choose a path they think is right. They seem to think they know better than the members they represent.


HERES the reality, each property owner is more repsonsible for CWA than any wash contractor. Propertys are supposed to comply, we are not alone and big money is actaully behind this. All this reclaim in un-needed sistuations are stupid, you will look stupid selling reclaim to that gas station owner in Maryland. He has it, he pays good money to maintain it.

You all say its not in your city, I'll bet anyone its suppose to be.
