Use of the word "SoftWash" in the New Orleans Pressure Washing Class curriculum

Hey Al I'll have to go back in there. I can tell you this a friend of mine got fined years ago $500 because he was caught advertising without a license. He's a landscaper who cuts grass. He needed a home improvement license. The second time it's considered criminal.

You better check again yourself as I will. There looking for revenue streams here themselves and better safe then sorry. Ask them if you advertise can you do it without a home improvement license in your line of work.



John give them a call and ask them. Say you just do Power Washing and nothing else. I can't see why you couldn't advertise, just power washing. You are not fixing the home or doing a Home Improvement. Just cleaning it.

I went down there to renew a few months back and this was an issue.. They told me and also wrote a letter for the state that I have to have a HP license. The problem was that I owed $11,000 + on my last quarterly taxes.. And according to the work that suffolk says I do I need the HP license.

I already paid the license for the next 2 yrs so I'll revisit it again then... It just sucks that so much of our work were supposed to charge sales tax.

I can't think of any service we offer in NYS that isn't subject to sales tax. Only work for non profits. Fortunately in the Capital District none of the counties require a business license.

John having a Home Improvement Lic is a good thing. I wouldn't work on a home with out it. As far as sales tax and a home Improvement lic. I don't see how they are connected. If you do repair work then tax is do. If you do a Home Improvement there is no NYS tax do.
 
I think he has already chimed in all he needs too. The rest of us have a choice to make as he does. But now, for me it's a dead issue and time to move on.

No offence Doug, but he has not chimed in on this..... He needs to show where he has the wordmark and how and where it is applicable. Guys have looked for it because they are looking for it, and they can't find it. You can't just go claiming something and telling someone to cease and desist, then not respond when asked for the proof. If thats the case, why don't we all just lie about everything and when were called out on it, we just don't need to respond? Alot of guys have softwash used in their name and marketing, and they need and want to know what their legal options are if AC is claiming to have the wordmark. It is far from a dead issue. Im not saying he doesn't have one, we just want to see it and know legally what we can say or not say....
 
Nah, I can't be bothered moving anything on Christmas day - we aren't the only ones with the ability to moderate threads/posts. I think as PWI staff you have that ability also.

Oh yeah I could have modified it,but I actually stand behind the things I say if I typed it I'll say it to him in person.

Tony removed what he considered offensive,but I got my point across....and NO I'm not off my meds just tired of watching this guy harrass the good people in this industry over the written word.Words/word that was around loooooooooooooooooooooooong before he professed to be the all knowing power in this industry.

And a question for Chris what was that cathedral made of that you sprayed 8 times?

I agree with Jeremy. He should post it here unless he wants all of us contacting him. That might not go over to well.
Is it just SoftWash or is it SoftWash System(s) or is it the term soft wash In any form that he's claiming? Either way he needs to explain what it is exactly and proof of it.

Why do I need to call him? What good would that do? He knows all about this thread and the people that want to know. I would rather he post it here in writing than me calling him and then its my word against his. This way, its in black and white with no confusion....
 
Scott, I was there with you in Tampa when we met AC. I've got to admit, I didn't care for what I saw of his persona at the onset. I was in the car sales business and have had my fill of the boisterous personalities like that.

But as time went on I developed a little more respect. He was lambasted on here, but he didn't run away and he didn't back down. In each situation it appears he has tried (and succeeded) to make things right. He posts some sarcastic quips every now and then, but if were you and you were on the up and up, yet people kept kicking you, I'd bet you'd come back with some sarcasm too.

Contrast the way AC has reacted to Tom Durbin who blew a gasket or the other guy in Tampa who was teaching inside restaurant cleaning and all the others who just turn tail and run when problems come up.

I know Doug says this is over, but I'd like to ask Nick, Scott and all the others who dislike AC so much, - Is there anything that can fix this situation? What needs to be done? Would a conference call with AC or an old fashioned internet conference thing like we used to do answer any questions or fix any of the problems. Nick, was your conversation with AC productive? Did it make any progress towards either of you understanding the other side or was it a complete waste of time?

I just know what it's like to be wrongly accused and I hope that isn't what has happened here. Maybe a conference call between all interested parties (Larry, you are invited to this party) would bring this to a conclusion one way or another.
 
Tony, all it would take is for him to show the wordmark.....its kind of like a legal document you can find on the internet, except the people that have been trying to find it...can't. All he would have to do is show the link for it or a copy of the paperwork. This isn't just to call AC out, this is potentially a legal situation since he has called out to NOLA to cease and desist using SoftWash cause he has a claimed wordmark on it. The next step would be a lawsuit, and all the guys are asking for is the proof...not to see if he is lying, but to also know what is legal for guys to use in their business names and marketing. I would hate to see someone here get sued and this thread is personally asking AC to show what can or cannot be used through the legal verification process so someone doesn't get sued. I dont think this is unreasonable to ask. Also, this thread can be shown in a court of law where it has been asked for him to provide the necessary legal information, and that if it is not given, it can be used against AC in a lawsuit.

Scott, please don't misunderstand the tone my response... We're good (I hope), I wasn't asking you to edit your post - just making the point that Scott S and I are not the only ones with 'the power'.

Tony I like Russ have that innate ability to smell BS from a mile away.I smelled it in Tampa and smell it every time AC starts some kind of drama for or in the industry.If you think the latest to "wordmark" isn't drama think again.This goes right back to Thad not letting AC have a spot in NOLA.
What I see is a self proclaimed,self serving man grasping at straws to try pick a fight over written words that existed long before he started selling his snake oil and the equipment to spray it.

Doug I share Jeremy "the tool" Kiefer's sentiments about phone calls they become a his word against mine situation and accomplish nothing.It's far easier for him to show what was asked of him here and be done with it.I guess AC will be sending out a lot of cease and desist letters since so many of us use a version of softwash,SoftWash etc. on our website and maketing materials.

Bottom line it's all a crock.

AC needs to sell his products and equipment to whom ever will buy them and stop pissing in the corn flakes of the industry that is helping put food on his family's table.

As a member over at Window Cleaning Resource, and an attendee at last year's NOLA event (and this year's event) I have to say that this is the best post I've read on this topic yet. Great post Scott.

With a wordmark, the company or product name is set in a specific typeface, often with some special treatment such as manipulated letters or corporate colors.


If I'm reading this correctly unless any of us use AC's spelling in the specific colors and fonts he uses we are free to do as we please with the words SoftWash,softwash,soft wash etc.

Scott, this is why it is so important for AC to show us what the wordmark is for, not just what he says. There is a specific web based document that anyone can find that lists exactally what the wordmark is for. It could be for the color, font, size, spacing, or all of the above. It makes a big difference for these guys to see the document so they know what is legal and what isn't.

Honestly Jeremy.......No, I don't care......So What? In the whole grand scheme of things what does it matter?......I mean Really? If he shows proof he shows it, if not it doesn't affect my business or yours one bit, just a "Non-Issue" for me at this point.

Tony, the phrase " A cold day in hell " was the first thing that came to mind when I read that. Sorry, but I have much better things to do than listen to a bunch of bs. BTW, good luck ever getting that to happen. It's safer to sling poop around with a one on one. It's makes it easier when the time comes for the he said, she said game. No other witnesses.
