Only washing the green parts on a fence

I've got an attorney working on it. I'm very reluctant to change since I've put 2 years and thousands of dollars into branding this name.
My attorney has emailed, mailed and called them... they refuse to respond. next step is to drag them to court. He said since I've got that voicemail of me getting declined a job because of the confusion, not only can they be forced to change their name, but I can also sue them for lost wages.
Let's hope this process goes smoothly. Seriously though, there's enough work here for someone not to have to piggy back off of another man's hard work. I'm not out to crush the competition or anything like that, I have a great relationship with multiple other local power washing contractors, but none of them have pulled off any jack moves on me like this, and they all do quality work.
Jeremy, don't know about trademarks, but you might try this route too. Maybe you can get him booted from google search results.
