One day elapsed. The FTC has laws about the 3 day right to cancellation. Those not aware of it, need to be. Those not following it, should be. The owner had every right to cancel the next day and to get a refund. Thank them for the opportunity, tell them you hope to serve them in the future, and move on professionally.

Some Exceptions

Some types of sales cannot be canceled even if they do occur in locations normally covered by the Rule. The Cooling-Off Rule does not cover sales that:
  • are under $25;
  • are for goods or services not primarily intended for personal, family or household purposes. (The Rule applies to courses of instruction or training.);
  • are made entirely by mail or telephone;
  • are the result of prior negotiations at the seller's permanent business location where the goods are sold regularly;
  • are needed to meet an emergency. Suppose insects suddenly appear in your home, and you waive your right to cancel;
  • are made as part of your request for the seller to do repairs or maintenance on your personal property (purchases made beyond the maintenance or repair request are covered).
Wouldnt the last line on here cover him from the cancellation......I have never aggreed with this cancellation rule/law.....your an adult make a decision and stick to it......give someone your word------shake hands and be a man and stick to what you agreed to!!!!!!!!!!!!

To much law involved in business today,,,,,some many can not stand up to their word.....what happened to doing business with a hand shake,,,,,,used to mean something.......no morals in todays society so therefore we have to have signed concracts!!!!!!!
 
I believe that is what covers your material returns. So if you buy a pail of Chem X and return it, and pay a restocking fee, that fee is deducted from the funds you return to the owner.

You also have to check your local home improvement licensing laws to see how this impacts you. It's a good thing to keep in mind.

We would have thanked them for the opportunity and returned the check. Good will goes a long way. Sometimes people DO come back and buy later, we have had that happen.

When doing residential I agree with Russ it makes you look like you can't afford to be in business and may make the customer feel like you are a fly by night or something. I've never once ask for a deposit and in four years in business I had one person not pay and it was a friend. go figure. I wouldn't take a deposit. What if something comes up and you can't do the job for a couple weeks then you have to give the money back and it's a hassle. thats just what I feel. But thats why we are all open minded on here. do what you feel is right.

I have never taken a deposit...they decided that it would be best to pay partially for the job and pay the rest over the next five months...They had asked for a payment plan and I indicated that this was not part of my business plan. Being a nice guy I told them the could pay the balance over the next five months. I was bending over backwards to help them. I guess I am going to have to revise my contract.

What if I had purchased stain mixed to the color of their liking?...I usually order commercial stain where it is shipped directly to me. I would hate to be stuck with a huge order (i.e. $500-$750)
 
One more thing...The HO had one quote for $200.00 and said the guy did not seem to know what he was talking about. For what it is worth, they were content to shop on the basis of price ONLY. They further indicated to me that insurance and being licensed was not an important consideration to them. I think in the end, that I am happy I did not do the work.There are guys out there who will low-ball and get the job. When disaster strikes such as damages to landscape from runoff etc...or screws popping a year later from the attached metal carport roof as a result of roof mix runoff---who will take the blame?:confused:....NOT ME!!!!:laugh:
