Vince Dispute that Card now, you have Protection for Six months. The BK cannot protect that Money Charged..... however you could see it Instant after 21 Day Dispute Policy. ( sometimes you have to put the Bank on Notice you Know this BK does not Protect him)

If your Bank cannot get it right Away Stay on top of Mail, a court will send you a Paper. You will fill it out and the Judge will order the Card company to take the Loss and refund you under federal protection credit act. ALL credit Commerce in a BK is protected up to six months.

I learned this Taking Cards from people who Went BK. Its no fun being involved in this, lets hope you paid by card and it had a Master Charge or Visa Symbol on it. Straight Debit card might be a different story.

I see a machine, a forklift and a trailer with a shop.

I am not saying to do this but someone could load that machine into that trailer and pay someone to drive it across country and then dispose of the trailer. I am not saying to do that but I am sure people are thinking about it.

Sorry to hear about this issue, that really sucks.

I would do what Ron says as he has been in this business for longer than most of us and probably has gone through similar situations.

Since 1999 I have purchased two complete trailer rigs from them.....never had a problem with there reputation, hopefully filing they will go out and make things right......
 
I happen to know that you weren't the only one they have apparently taken payment on and not delivered the goods. I hate that this happened.

You're absolutely right Stephen, I'm not the only one that's getting the shaft on this deal. I talked to a few other people today and they are getting it also.
 
Is that machine yours possibly? Hopefully it's sitting there ready to ship as promised?

The machine in the picture isn't mine, even if it was mine I wouldn't want it now anyways.

These are on personal thoughts as to what is going to happen.

They will close up shop and file for BK. Wait a few weeks or a month for the dust to settle and reopen at the same location under a different name, different logo, different phone number and use different suppliers for their parts. Unfortunately this happens more often than people think. I really don't think this is the last of them personally.

Right now I really don't even want their existing unit on my truck. I'll sell it along with the propane tank and spare heating coil I have also for it. If I don't get any decent offers on it then I'll keep the pump and motor (18HP Kohler and a General TS2021 Pump), scrap the coils and the frame of it. If I decide to scrap the frame and coils on it I'll send Al the burner control unit for it if he wants it as a spare for his units.
 
Vince....got a Landa sitting on a pallet. If you need a skid in the interim until all the mess gets straighten out....just come up and pick it up!

Thanks for the offer Carlos, my existing unit is still running but I'll keep that in the back on my mind in case something happens while I get this all sorted out.

Thinking along the same lines, I asked if they had any equipment for a fire sale, as businesses closing up do. Usually I will get one of two different answers: 1) "No not really, we'll probably just hold onto everything, maybe put it into storage until we decide later what we are gonna do with" or 2) Yes, absolutely everything is for sale, just name your price".



I got answer #2. Wayne even took me around and showed me some fabrication equipment for sale, as well as some that is already shrink wrapped, sold, and ready for shipping. Which tells me they are selling off assets, while the BK paperwork is going through, so that they can raise as much CASH as possible instead of it going at auction to settle debts. I even inquired about the forklift you see in the pics, and the guy said he'd give me call as it would be the last thing they sell.

During the walk through looking at equipment for sale, I casually mentioned, "I was really talking about PW'ing equipment, or rigs" and he said, "aww hell no we build everything to spec as it is ordered, as you can see this ain't no show room, these guys are finishing up, (pointing to the workers working on a trailer rig) a few jobs we have open and then we're done"
 
This thread is a compliment to contractors who help each other out and are true professionals. I obviously do not like what is happening to Vince but it is great to see people like Steve, Doug, and Carlos going the extra mile to help. Really like these type of threads that show the best in this industry. Compliments to all and good luck Vince!
