Chris, you need to be more proactive, and they need to be getting you a comarable machine to replace it. I would call Espec and find out what a cost for a comparable machine would be, then work from there. There is no reason that they should be leaving you twisting in the wind on this.

I agree with Scott But may I please add this? Try and keep a level head when meeting up with the shop owner. He should be doing whatever he can to help but going off on him may slow that downn a little, know what i mean? good luck Chris.
 
First off did you sign anything that released them of responsibility? Second all shops have garage keeper insurance. Did you file a police report? If so when ? If the place waited two weeks that's negligence it's it self, waiting only means less chance of recovery. Was This just a skid or trailer , it matters. If your home owners has garage insurance it will carry over in az. They will pay you and I guarantee they collect from garage.

The next piece of advice is do they pay rent? Or do they own the place of business. If they rent the lease requires insurance.

Chris I get the guy on the phone , I start taking about the damages , income lost and now aggravation. Funny how a simple letter telling them your intention if they are claiming no fault. Record it all, ask them how it was stolen? I had this happen to me long ago, it was one of there employees.


Second if the guy doesn't take responsibility then get the media involved.

Are you leaving anything out? Was other property stolen? Is this guy sound financially? Did he collect on your unit and is not telling you?

Nothing here adds up, I'm suspect to something else is going on.

Garage keepers care and custody policy should cover it. I cannot imagine they would not have one if they are taking possession of anyones stuff.

If they are renting the landlord will require it. Chris are you going to respond. The insurance person using a parking lot at the mall being the same situation is ridiculous.

I tried a lot of times last nite to respond but kept getting an error stating that my response needs to be more than 5 characters, I was typing a lot more than that.

Chris, I saw where you said the shop had no insurance. It is time to get an attorney and assert that they will not only have to pay for the Pressure washer, at replacement cost, but all attorney fees as well. Even if they did not have insurance, which I find doubtful, they are still liable for replacement, because it was in their care, custody and control. That they waited two weeks to call you just exacerbates the problem.

Don't let them get away with Chris. A repair shop had a accident in the box van I bought in Ohio in Indianapolis and their insurance is covering everything.
 
I talked to the owner and he said that he is waiting on his insurance company to contact him but he said that they are not responsible for my machine and that to put a claim in on my insurance.

I mentioned that my insurance dropped the ball about adding the machine to the policy this year.

I mentioned to him that it was under his care, custody and control and he told me that he is not responsible for anything there after 30 days (it had been there for a while but they reminded me to pick it up a few weeks ago and then it was stolen).

We got into an argument and then I hanged up the phone. I called around to different attorneys and explained the situation and one will be calling me back later today or tomorrow. The secretary was concerned that it had been there a long time but that is not the issue here, it is about getting stolen on their property unless I am wrong here.
 
the fact that he says he is not responsible after 30 days proves that he does have responsibility. that 30 days is for abandoned stuff like broken $100 weed wackers. not 7k dollar skid units. thats b.s
 
If the 30 day notice is posted in his shop, and if the machine had been repaired or repairs refused, and notice was given to pick it up, and 30 days has elapsed, it's abandoned. I have sold equipment for the cost of the repairs. No skids, but a couple of cold water machines and a generator or two.

Your right Russ abandoned is abandoned, whether its a skid unit or a die grinder. value has no play in it.

but when does the thirty days start? after the last attempt to notify the owner ? the shop owner called chris and said to pick it up then 3 to 7 days later it was stolen, seems like plenty of time to me. I dont really know for sure because i do not know the laws of his state, but if the shop had a sign that said not responsible for anything, ever then i think chris would be s.o.l. but the simple fact is the sign admits him having responsability for it.
 
You are right Russ, it had been ready for a while.

The secretary gave me a reminder call and I told her I would be in to get it within a week or so but then within a few days of her call it was stolen.
